Benton Sports Swap reserves the right to make changes to the Terms and Conditions at any time in its sole discretion. It is your responsibility to review the updated consignment terms at the time of consigning new items. 

A. Pricing: Benton Sports Swap makes the final selection regarding all items placed on consignment. Anything not accepted must be picked up within 7 days or will become the sole property of Benton Sports Swap and will be donated. Benton Sports Swap sets prices on all consigned items based on current resale market, demand, and item condition. If you have a preferred price point, this must be communicated upfront. Monthly markdowns of each item that stays past 1 month will occur. Periodically, items must be discounted for promotional sales and discounts at the discretion of Benton Sports Swap.

B. Consignment Split: The Consignor will receive 50% of the final selling price on items sold during the 6-month consignment contract period.

C. Payment Terms: All payments must be made via cash, check, venmo or store credit and will accrue during the consignment contract period to be paid out on a once-monthly or 6-month contract basis ending on the last calendar day of the month. The consignor can have payment mailed, venmo'd or picked up from the storefront. Benton Sports Swap assumes no responsibility for lost checks or payments. Re-issued checks will incur a $30 stop payment fee.

D. Consignment Period and Donation Policy: All items are consigned for approximately 6 months. At the end of the consignment period, the Consignor will be responsible for pickup of the consignments. All consignors are responsible for monitoring the expiration date of their items. Unsold items not picked up within 2 weeks following the completion of the 6-month consignment period becomes the sole property of Benton Sports Swap.  Benton Sports Swap reserves the right to donate items of the recipient of their choice at any time following the 2 weeks after the completion of the 6-month period.

E. Conditions of Items: Benton Sports Swap only accepts sport-related equipment, gear, gifts, and athletic clothing. The consignor can bring in any number of items to consign at any time during business hours. Items should be clean and free of any stains, holes, or smells. We will not accept damaged equipment or gear. Anything not accepted must be picked up within 7 days or will be donated. 

F. Returns: Benton Sports Swap does not accept returns.

G. Limitation of Liability: Benton Sports Swap will take diligent care of the consigned pieces to the best of its ability. Benton Sports Swap does not cover losses to consigned property for theft or damage. This includes any damage caused by a customer, fire, flood, earthquakes, stains, tears, missing pieces, damage that occurs during shipping, or any other damage with no exclusions of man-made of natural damages to consigned items.

H. Inactive Account: After two (2) consecutive years of inactivity on the Consignor's 

account, the Consignor will forfeit any unclaimed Accrued  Consignor Balance, and the Benton Sports Swap will be under no obligation to issue payment.

I. Legal Right to Consigned Item: The consignor guarantees that all items consigned to Benton Sports Swap for sale are lawfully and entirely owned by the Consignor or that they are acting on behalf of a person(s) who has given the authority to sell such items on their behalf. The Consignor guarantees to indemnify Benton Sports Swap for any damages, penalties, fines, fees, or judgments for any issue arising due to the rights of the lawful owner of the merchandise being placed on consignment.

J. Sales Outlets: Consignor agrees that items accepted for consignment may be sold in-store or online via multi-media accounts of their choice.

K. Keeping Contact Information Current: It is the consignor's responsibility to update Benton Sports Swap of any changes to the mailing address, email, or phone number of record. Failure to do so may result in delayed payments, loss of payments, or additional fees for checks to be reissued and mailed.

L. Changes to Terms: Benton Sports Swap reserves the right to change the terms of this contract.
